Terms of Service

1. Eligibility

You must be at least 13 years old (16 in the EEA/UK) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. Creators receiving payouts must be 18 or older.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms.

3. User Content

You retain ownership of the content you upload to AnimeKuni ("User Content"). By submitting User Content, you grant AnimeKuni a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, transmit, transcode, publicly display, publicly perform, and distribute your User Content in connection with operating and promoting the Service, including across our content delivery network and on mobile and embedded surfaces.

You represent and warrant that (a) you own or have all necessary rights to your User Content, (b) your User Content does not infringe any third-party rights, and (c) your User Content complies with these Terms and applicable law.

4. Acceptable Use

You agree not to:

• Upload content that infringes intellectual property, publicity, or privacy rights.
• Upload sexually explicit content involving minors.
• Harass, threaten, dox, or incite violence against any person or group.
• Upload malware or attempt to disrupt the Service.
• Scrape, mass-download, or otherwise misuse the Service's content or APIs.
• Circumvent age gates, membership gates, or geographic restrictions.
• Use the Service to violate any law.

5. Premium Subscriptions

AnimeKuni Premium is an optional paid subscription that provides an ad-free experience, early access to selected episodes, and other features described at checkout. Premium billing is monthly unless otherwise stated, automatically renews until cancelled, and is processed by Stripe. You may cancel anytime through your account settings; access remains active through the end of the current billing period. Refunds are at our discretion.

6. Creator Memberships

Creators may offer paid membership tiers that include access to members-only content, subscriber badges, and other perks. AnimeKuni acts as the platform that facilitates these subscriptions through Stripe Connect. The creator sets the price, currencies, and perks; AnimeKuni retains a 30% platform fee, and 70% is paid to the creator. Memberships auto-renew until cancelled. We are not responsible for the content of any specific membership tier.

7. Creator Earnings & Payouts

Creators must complete Stripe Connect onboarding (identity verification, tax forms) before receiving payouts. Payout schedules and minimums are set by Stripe. Earnings from ads, memberships, tips, and merch are credited to the creator's connected Stripe account, net of the platform fee and any chargebacks or refunds. We may withhold payouts in cases of suspected fraud, policy violations, or legal investigations.

8. Intellectual Property

AnimeKuni, the AnimeKuni logo, and other marks are trademarks of AnimeKuni, Inc. Except for User Content, all material on the Service is owned by AnimeKuni or its licensors and is protected by intellectual property laws. Nothing in these Terms grants you a license to our marks or proprietary software.

9. Copyright (DMCA)

AnimeKuni complies with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, see our DMCA Policy for our designated agent and notice procedure. We will terminate accounts of repeat infringers.

10. Termination

We may suspend or terminate your account at any time for violations of these Terms or for conduct we determine to be harmful to other users or the Service. You may terminate your account at any time through your account settings. Sections that by their nature should survive termination (User Content license for already-distributed copies, indemnification, disputes) will survive.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANIMEKUNI AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY UNDER THESE TERMS IS LIMITED TO THE AMOUNTS YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR USD $100, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold AnimeKuni harmless from claims, damages, and expenses arising from your User Content, your violation of these Terms, or your violation of any law or third-party right.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflicts of law principles. Any disputes will be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring small-claims actions or seek injunctive relief in court. You waive any right to participate in a class action.

15. Changes

We may update these Terms from time to time. If we make material changes, we will provide reasonable advance notice. Continued use of the Service after the effective date constitutes acceptance.
